Our confidentiality commitment

  • We guarantee absolute reserve and a confidentiality clause under which CENIPSA SAS commits never to use your information for any purpose beyond your case. At the close of each engagement, the resulting material is delivered to you, and no copies are kept or disclosed.
  • Our personnel are bound by this confidentiality clause for the benefit of the client. All work is coordinated from Bogotá to eliminate the risk of information leaks.

The private investigator is, by nature, a collaborator with the justice system (Article 257 of the Political Constitution of Colombia, Article 85(21) of Law 270 of 1996, and Law 446 of 1998).

Under the Accusatory Criminal System (Law 906) and the General Code of Procedure governing civil, labor, and administrative matters, evidentiary practice in Colombia has changed radically. Responsibility for gathering evidence no longer rests with judges: the parties themselves must arrive at trial with the evidence they intend to rely on, already collected. The former roster of court-appointed experts has also disappeared, so each party must bring its own experts. This strengthens the pre-litigation investigative process and closely links private investigators, forensic experts, and attorneys, who must now work jointly to relieve the burden on the courts.

CENIPSA SAS advises the defense on chain of custody, covering the legality, authenticity, integrity, preservation, security, storage, continuity, and registration of the physical and intangible evidence relevant to each case.

The General Code of Procedure also requires that, for evidence to be admissible, private investigation firms include “Private Investigations” within their corporate purpose. CENIPSA SAS is a legally constituted company whose incorporation document, registered with the Bogotá Chamber of Commerce, expressly lists this activity as its corporate purpose, fully meeting every legal requirement for firms of this kind.
